DMCA (Digital Millennium Copyright Act)

IlmCodex (https://www.ilmcodex.com) respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond to clear notices of alleged copyright infringement.

This page explains:

  • How copyright owners can report infringing content on IlmCodex.
  • How we handle such notices.
  • How users who believe their content was removed in error can file a counter-notification.

By using IlmCodex, you agree to the terms of this DMCA policy.


1. Our Commitment to Original Content

IlmCodex is a website dedicated to fast food recipes, restaurant reviews, and cooking tips. We create all our content — including written articles, recipe instructions, and original photographs — in-house. We do not knowingly copy, republish, or distribute copyrighted material belonging to others.

However, mistakes can happen. If you believe that any content on IlmCodex infringes your copyright, please follow the procedure below.


2. Filing a DMCA Takedown Notice (For Copyright Owners)

If you are a copyright owner or an authorized agent and believe that material on IlmCodex violates your exclusive rights, you may submit a written DMCA notice to our designated Copyright Agent.

Your notice must include substantially the following:

Required Information:

  1. Physical or electronic signature of the copyright owner or person authorized to act on their behalf.

  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered, provide a representative list.

  3. Identification of the material that is claimed to be infringing and that should be removed. Include the specific URL(s) of the page(s) on IlmCodex where the material appears.

  4. Your contact information – full name, mailing address, telephone number, and email address.

  5. A good faith statement that you believe the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (e.g., not fair use).

  6. A statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

We aim to acknowledge receipt within 2 business days and take appropriate action (typically removal) within 5–7 business days after verification.


3. What We Do Upon Receiving a Valid DMCA Notice

Upon receiving a complete and valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user (if we have their contact information) who posted the material that it has been removed due to a copyright complaint.
  • Make a good faith effort to contact the user and provide them with a copy of the notice.
  • Keep a record of the notice for legal purposes.

We may also, in appropriate circumstances, terminate the accounts of repeat infringers (e.g., users who submit multiple infringing comments or guest posts).


4. Counter-Notification (If Your Content Was Removed by Mistake)

If you believe that your content was removed or disabled as a result of a mistake or misidentification (e.g., you own the copyright or have permission, or your use qualifies as fair use), you may send us a counter-notification.

Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal (the original URL).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed due to mistake or misidentification.
  4. Your contact information – name, address, telephone number, and email address.
  5. Your consent to the jurisdiction of the federal court in your judicial district (or the district where we are located), and that you will accept service of process from the person who filed the original DMCA notice.

Send counter-notifications to the same email address: support@ilmcodex.com with subject: "DMCA Counter-Notice – [Your Name]".

If we receive a valid counter-notification, we may send a copy to the original complainant. If the original complainant does not file a court action within 10–14 business days, we may restore the removed content.


5. Repeat Infringer Policy

IlmCodex maintains a strict policy against repeat infringement. Users or commenters who are the subject of multiple valid DMCA notices may have their access to post comments or guest content permanently terminated. For website owners (not applicable to IlmCodex itself), we reserve the right to terminate accounts that repeatedly infringe.


6. Important Notes for Copyright Owners

  • False claims: Knowingly misrepresenting that material is infringing (or that it was removed by mistake) can make you liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA. Please be certain before filing.
  • Fair use: We respect fair use rights. If your work is being used for commentary, criticism, news reporting, or research, it may not be infringing. Please evaluate before sending a takedown notice.
  • Cookbook recipes: Lists of ingredients and simple cooking instructions generally are not copyrightable. However, substantial original text, photos, and creative expression are protected. If you believe your unique recipe explanation or photo has been copied, please proceed.
